In order to insure justice in its judicial system, Islam has laid down golden principles of evidence. The evidence (bayyinah) in a broad sense is anything that proves or disproves the fact disputed in a court. The main aim of the evidence in Islam is that an innocent must not be punished and a guilty must not escape from punishment. The evidence is a restrainer to false, weak and un substantiated claims and complaints. As everyone is presumed to be inherently innocent, only a conclusive and convincing evidence can overcome this presumption.
